1. Acceptance of Terms

By registering, accessing or using Maison State (hereinafter "the Service"), you agree to be bound by these Terms and Conditions (hereinafter "the Terms") and our Privacy Policy. If you do not agree with any provision, you must refrain from using the Service.

2. Description of the Service

Maison State is a software-as-a-service (SaaS) platform that uses artificial intelligence to generate real estate marketing content, including professional PDFs, Instagram posts, stories, carousels, HTML emails, and video reels with music and voice narration. The Service is provided through the website maisonstatepro.com.

3. User account

To use the Service you must create an account providing truthful and updated information. You are responsible for:

• Maintaining the confidentiality of your password.
• All activity carried out under your account.
• Notifying us immediately of any unauthorized use.

We reserve the right to suspend or delete accounts that violate these Terms.

4. Plans and payments

Maison State offers the following plans:

• Free: $0 USD/month — 2 listings per month, limited features.
• Pro: $29 USD/month — 15 listings per month, all features.
• Business: $79 USD/month — 35 listings per month, up to 5 users.

Payments are processed monthly through Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel the subscription.

5. Cancellation and refund policy

You may cancel your subscription at any time from your account panel. Upon cancellation:

• Your plan will remain active until the end of the period already paid.
• No refunds will be issued for partial or unused periods.
• You will retain access to content generated during the active period.

We do not offer refunds for paid periods, unless required by applicable law or in the event of a serious technical failure attributable to Maison State that prevents the use of the Service for more than 50% of the billed period.

6. Acceptable use

When using the Service, you agree NOT to:

• Generate false, misleading or fraudulent content about properties.
• Upload property photographs without authorization from the owner or responsible agent.
• Use the Service for illegal activities or activities that infringe third-party rights.
• Attempt to access without authorization the systems, data or accounts of other users.
• Resell, redistribute or sublicense the Service without written authorization.
• Use bots, scripts or automated tools to abuse the Service.

Non-compliance may result in immediate suspension without refund.

7. Intellectual property

Your content: You retain all rights to the photographs, descriptions and property data you upload to the Service. By using Maison State, you grant us a limited license to process them exclusively for the purpose of generating the requested content.

Generated content: Materials generated by AI from your content belong to you and you may use them commercially without restrictions, within the limits of your plan.

Platform: The software, design, brand and code of Maison State are the property of Luis Alberto Vázquez Reyes and are protected by intellectual property laws. Copying, modifying or distributing without authorization is prohibited.

8. Limitation of liability

The Service is provided "AS IS" without express or implied warranties. Maison State is NOT responsible for:

• Errors, inaccuracies or inappropriate content generated by AI. You must review all content before publishing it.
• Service interruptions due to maintenance, third-party failures (Stripe, OpenAI, ElevenLabs, etc.) or force majeure.
• Indirect damages, lost profits or loss of business opportunities arising from the use of the Service.
• Business or legal decisions made based on the generated content.

The maximum liability of Maison State, in any case, is limited to the amount paid by you in the last 3 months.

9. AI-generated content

The content produced by the Service is generated using artificial intelligence models. Although we seek the highest possible quality, it may contain errors, inaccuracies or not faithfully reflect the property described. It is the user's sole responsibility to review, correct and validate all content before publishing it or using it commercially.

10. Suspension and termination

We may suspend or terminate your access to the Service in case of:

• Breach of these Terms.
• Lack of payment.
• Fraudulent or abusive use.
• Request from competent authorities.

You may terminate the use of the Service at any time by canceling your account.

11. Modifications to the Terms

We may update these Terms when necessary. Changes will take effect upon being published on the Service. For substantial changes, we will notify you by email at least 15 days in advance. Continued use of the Service implies acceptance of the updated Terms.

12. Applicable law and jurisdiction

These Terms are governed by the laws of the United Mexican States. Any controversy will be resolved before the competent courts of the city of Poza Rica de Hidalgo, Veracruz, Mexico, with the parties waiving any other jurisdiction that may correspond to them.
